These Terms of Service ("Terms") govern your access to and use of the Aeloria website at www.useaeloria.com, the Aeloria Creator Portal, and the Aeloria creator network (collectively, the "Service"). By submitting an application, creating an account, or using any part of the Service, you agree to be bound by these Terms.
Aeloria is operated by Persistence Prevails ("we," "us," or "our"). If you do not agree to these Terms, do not use the Service.
1. Eligibility
You must be at least 18 years old to apply to or participate in the Aeloria network. By submitting an application, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
You must be the owner of the YouTube channel submitted in your application. Submitting a channel you do not own or control is grounds for immediate rejection or removal from the network.
2. Application and Approval
Submitting an application does not guarantee acceptance. We review every application at our sole discretion and may accept or reject any applicant for any reason, including but not limited to content quality, niche fit, upload cadence, and channel history.
Channels meeting our undisclosed eligibility criteria are auto-approved instantly upon submission, subject to subsequent review. Other channels are reviewed manually, typically within 1–2 business days, but this is an estimate, not a guarantee. We reserve the right to revoke an auto-approval, modify the auto-approval criteria at any time, request additional information, or reject any application at our discretion.
If approved, we will create a Creator Portal account for you and send login credentials to the email address you provided. You are responsible for maintaining the confidentiality of your credentials.
3. The Partnership
3.1 How it works
As an approved creator, you agree to use tracks from the Aeloria music catalog as background audio in your YouTube Shorts. When you do, YouTube routes a portion of Shorts advertising revenue to the "Music Pool," which is paid to the rights-holder of the music used — in this case, Aeloria. We then share a percentage of that Music Pool revenue with you according to your tier.
3.2 Revenue tiers
All approved creators start at the Starter tier (50/50 split). Tier upgrades to Growth (65/35) and Elite (80/20) are determined at our sole discretion based on sustained performance, consistency, and contribution to the network. Tier placement is reviewed quarterly.
We reserve the right to modify tier structures, percentages, and qualification criteria at any time. Material changes will be communicated to active creators via email at least 30 days before taking effect.
3.3 No exclusivity
This is a non-exclusive partnership. You are free to use other music in your Shorts and to participate in other creator networks or programs. You only earn Music Pool revenue from videos that use Aeloria catalog tracks.
3.4 No effect on Creator Pool earnings
Using Aeloria catalog tracks does not affect your YouTube Creator Pool earnings (your regular Shorts ad revenue). The Music Pool is a separate revenue stream.
4. Payments
4.1 Royalty reporting delay
YouTube Music Pool royalties are subject to an approximately 3-month reporting delay. This is an industry-standard delay imposed by YouTube's royalty processing timeline, not by Aeloria. Revenue earned in a given month will typically be reported and payable approximately 3 months later.
4.2 Payout schedule
After the initial reporting delay, payouts are processed monthly on a rolling basis. The specific payout date within each month may vary.
4.3 Minimum payout threshold
The minimum payout amount is $100 USD. If your accrued balance for a payout period is below $100, the balance rolls over to the next period. Once your accumulated balance meets or exceeds $100, the full balance is paid out in the next cycle.
4.4 Payment method
Payment method and details are arranged during onboarding. You are responsible for providing accurate payment information. We are not liable for delays or failures caused by incorrect payment details provided by you.
4.5 Taxes
You are solely responsible for any taxes, duties, or other governmental assessments associated with your receipt of payments from Aeloria. We may request tax documentation (such as a W-9 or W-8BEN) before issuing payments, as required by applicable law.
4.6 Revenue accuracy
Revenue figures are based on data reported to us by YouTube and our music distribution partners. While we make every effort to ensure accuracy, we do not guarantee that revenue figures are error-free. In the event of a discrepancy, we will work with you in good faith to resolve it.
4.7 Balance adjustments and forfeiture
We reserve the right to adjust, withhold, or forfeit any unpaid balance on your account in the following circumstances:
- Fraud or abuse: If we reasonably determine that your account activity involves artificial view inflation, bot traffic, click fraud, or any other form of manipulative behavior designed to inflate earnings.
- Terms violations: If you materially breach these Terms, including misrepresentation of channel ownership, viewership, or other information provided to Aeloria.
- Technical or reporting errors: If a balance was credited due to a technical error, duplicate entry, incorrect data from upstream reporting partners, or other miscalculation. In such cases, we will correct the balance to reflect accurate figures.
- YouTube policy changes: If YouTube retroactively adjusts, claws back, or reverses Music Pool payments previously reported to us, we may adjust your balance accordingly.
- Chargebacks or payment disputes: If a previous payout is reversed or disputed by a payment provider.
Where reasonably possible, we will notify you of any balance adjustment and provide an explanation. Adjustments due to technical or reporting errors will be corrected to reflect the accurate amount — not forfeited.
5. Creator Obligations
As an Aeloria network creator, you agree to:
- Only use Aeloria catalog tracks that are made available to you through the Creator Portal or YouTube's audio library.
- Set the music volume to at least 20% when adding Aeloria tracks to your Shorts, so YouTube can properly detect and attribute the track.
- Log each video that uses an Aeloria track through the Creator Portal (video URL, publish date, and song used).
- Not misrepresent your channel, viewership, or any other information provided to Aeloria.
- Not engage in any form of artificial view inflation, bot traffic, or other manipulative practices.
- Comply with YouTube's Terms of Service and Community Guidelines at all times.
- Not redistribute, re-upload, or sublicense Aeloria catalog tracks outside of their intended use in YouTube Shorts.
6. Intellectual Property
6.1 Our music
All tracks in the Aeloria music catalog are owned by Aeloria or its licensors. We grant you a limited, non-exclusive, non-transferable license to use catalog tracks solely as background audio in your YouTube Shorts while you are an active member of the network. This license terminates immediately upon your removal from the network or voluntary departure.
6.2 Your content
You retain all rights to your original video content. We do not claim ownership of any videos you create. By logging videos in the Creator Portal, you grant us permission to reference those videos internally for revenue tracking and attribution purposes only.
7. Termination
7.1 By you
You may leave the network at any time by contacting us at hello@useaeloria.com. If you have an outstanding balance above the minimum payout threshold at the time of departure, we will process a final payout within 60 days, subject to the standard royalty reporting delay.
7.2 By us
We may suspend or terminate your participation in the network at any time, with or without cause, including but not limited to: violation of these Terms, violation of YouTube's Terms of Service, engagement in fraudulent activity, inactivity for an extended period, or conduct that we reasonably believe harms the network or other creators.
If we terminate your participation, any accrued balance above the minimum payout threshold will be paid out within 60 days. If termination is due to fraud or abuse, we reserve the right to withhold unpaid balances.
7.3 Effect of termination
Upon termination, your license to use Aeloria catalog tracks ceases immediately. Videos already published with Aeloria tracks prior to termination may remain live — we will not issue takedown requests against your existing content. However, you will no longer receive Music Pool revenue from those videos after termination.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee any specific level of earnings. Revenue depends on factors including but not limited to: video performance, viewer geography, YouTube's revenue allocation algorithms, advertiser demand, and seasonal fluctuations. Any earnings projections, examples, or estimates shown on our website or in communications are illustrative only and do not constitute guarantees.
We are not responsible for changes to YouTube's Shorts revenue model, Music Pool structure, or royalty reporting practices. If YouTube materially changes how the Music Pool operates, we will communicate the impact to creators, but we cannot guarantee continuity of the revenue model.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Aeloria and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total amount of payments actually made to you by Aeloria in the 12 months preceding the claim.
10. Modifications
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date and notify active creators via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Sweden.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
13. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aeloria regarding the Service and supersede any prior agreements or communications.
